By accessing or using the SourBoys website, mobile app, or services (the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.
SourBoys is a candy and confectionery brand operated by Offbrand, LLC DBA SourBoys ("SourBoys," "we," "us," or "our"), offering various sweet products through our online platform. We reserve the right to modify our product offerings, prices, and services at any time.
You must be at least 18 years old to make purchases. Minors may browse our site but require parental consent and supervision for any purchases. Parents and guardians are responsible for monitoring their children's use of our Services.
IMPORTANT: Our products may contain or be processed in facilities that handle common allergens, including gluten. If you have food allergies or dietary restrictions, please carefully review all product information and consult with a healthcare professional before consuming our products.
Returns and refunds are governed by our separate Return & Refunds Policy. Food safety regulations may limit our ability to accept returns of certain items.
These Mobile Messaging Terms apply to the SourBoys text message program (the "SMS Program").
Program description. By opting in to the SMS Program, you consent to receive recurring automated marketing and informational text messages from SourBoys at the phone number you provided. Messages may include back-in-stock alerts, cart reminders, promotions and other marketing messages, and informational messages such as order updates. Messages may be sent using an automatic telephone dialing system or other automated technology.
Consent is not a condition of purchase. You are not required to opt in to the SMS Program to purchase any goods or services.
Message frequency and cost. Message frequency varies. Message and data rates may apply. Check with your mobile carrier for details on your plan.
Age requirement. The SMS Program is intended for individuals 18 years of age or older. By opting in, you represent that you are at least 18 years old.
Opting out. You can cancel the SMS Program at any time by replying STOP to any message we send you. After you send STOP, we will send you a single message confirming your opt-out, after which you will no longer receive text messages from us unless you opt in again. Reply HELP to any message for assistance, or contact us using the details in Section 20.
Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is outside our control.
Changes to the SMS Program. We may change, suspend, or terminate the SMS Program, or change any short code, toll-free number, or keyword, at any time. We may also change these Mobile Messaging Terms as described in Section 15.
Your phone number. You represent that you are the account holder for the phone number you provide, or that you have the account holder's permission to enroll it. You agree to notify us promptly if you change or deactivate your phone number, so that we do not send messages intended for you to someone else.
Privacy. Phone numbers and opt-in data collected through the SMS Program are handled as described in our Privacy Policy, and text messaging originator opt-in data and consent will not be shared with or sold to any third parties, excluding the service providers necessary to deliver our messages.
All content on our website, including logos, product names, images, and text, is owned by SourBoys or our licensors. You may not use our intellectual property without written permission.

We may terminate or suspend your access to our Services at any time, with or without cause or notice.
These Terms are governed by the laws of the State of Texas and the United States of America, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Erath County, Texas, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, Return & Refunds Policy, and any other policies posted on our website, constitute the entire agreement between you and SourBoys regarding the Services.
